This website is operated by Whereto Design LLC. Throughout the Site, the terms “we,” “us,” and “our” refer to Whereto Design LLC.
Whereto Design LLC operates the Whereto® online store and offers this website, including all information, tools, products, and services available through the Site, subject to your acceptance of these Terms of Service and all policies and notices referenced herein.
Whereto® is a registered trademark owned by Happy Manta, Inc. and is used by Whereto Design LLC with authorization. Unless otherwise stated, the original artwork and creative content displayed on the Site are owned by or used with authorization from Happy Manta, Inc.
By visiting the Site, creating an account, purchasing a product, submitting information, or otherwise using any part of the Services, you agree to be bound by these Terms of Service, collectively referred to as the “Terms.”
These Terms apply to all users of the Site, including visitors, customers, account holders, wholesale buyers, vendors, merchants, and contributors of content.
Please read these Terms carefully before accessing or using the Site. If you do not agree to these Terms, you may not access the Site or use the Services.
Any new features, products, services, or tools added to the Site will also be subject to these Terms. We may update or replace any portion of these Terms by posting a revised version on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
Our online store is hosted by Shopify. Shopify provides the ecommerce platform that enables us to offer products and Services to you.
Section 1 — Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your state, territory, province, or country of residence, or that you are the age of majority and have authorized your minor dependents to use the Site under your supervision.
You may not use our products or Services for any illegal, fraudulent, or unauthorized purpose. You may not violate any applicable law while using the Site, including intellectual-property, privacy, consumer-protection, export, sanctions, or ecommerce laws.
You must not transmit viruses, worms, malicious code, or any other material intended to damage, disrupt, interfere with, or obtain unauthorized access to the Site or related systems.
A violation of these Terms may result in the suspension or termination of your access to the Services.
Section 2 — General Conditions
We reserve the right to refuse, restrict, suspend, or cancel Service or an order when reasonably necessary, including in cases of suspected fraud, abuse, pricing errors, inventory errors, policy violations, prohibited transactions, or legal and regulatory requirements.
Content you submit to the Site, excluding payment-card information, may be transmitted through different networks and adapted to meet technical requirements. Payment-card information is encrypted during transmission by the applicable payment processor.
You may not reproduce, duplicate, copy, sell, resell, exploit, scrape, or commercially use any portion of the Site or Services without prior written authorization from Whereto Design LLC and, where applicable, the relevant intellectual-property owner.
The headings in these Terms are included for convenience and do not limit or affect the interpretation of any provision.
Section 3 — Accuracy and Timeliness of Information
We endeavor to provide accurate and current information, but we do not guarantee that all information on the Site will always be complete, current, or free from errors.
Information on the Site is provided for general purposes and should not be relied upon as the sole basis for making decisions when more accurate, complete, or current information is reasonably available.
The Site may include historical or archived information that is provided for reference only.
We may update, correct, modify, or remove Site content at any time, but we are not obligated to update all information except as required by applicable law.
Section 4 — Changes to Services and Prices
Product prices, promotions, availability, specifications, packaging, and other details may change without prior notice.
We may modify, suspend, or discontinue any product, feature, or portion of the Services at any time.
To the maximum extent permitted by law, we are not liable for changes to pricing, product availability, promotions, features, or Services.
Section 5 — Products and Services
Certain products or Services may be available exclusively online and may be offered in limited quantities.
Returns, refunds, replacements, and exchanges are governed by our Refund Policy, which is available through the Site footer and checkout.
We make reasonable efforts to display product colors, images, dimensions, finishes, materials, and other details accurately. However, screen displays, lighting, production methods, natural material variations, printing processes, and manufacturing tolerances may cause the actual product to vary slightly from photographs or digital previews.
Our products may feature original hand-drawn or digitally reproduced artwork. Minor differences in placement, color, scale, texture, finish, or production may occur and are not necessarily defects.
We may limit sales by person, household, order, geographic location, or jurisdiction. We may also limit product quantities, discontinue products, or decline orders that appear intended for unauthorized resale, fraud, abuse, or another prohibited purpose.
Product descriptions and prices are subject to correction or change. Any offer made through the Site is void where prohibited by law.
We do not guarantee that every product or Service will meet every individual expectation. Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.
Section 6 — Production, Fulfillment, and Shipping Partners
Some products may be manufactured, printed, stored, packaged, or shipped by authorized production partners, print-on-demand providers, warehouses, logistics providers, or fulfillment partners.
Accordingly:
- Products in the same order may arrive in separate shipments.
- Production and dispatch locations may vary.
- A fulfillment or production partner’s name or address may appear on shipping labels or packaging.
- Estimated production and delivery times are not guaranteed.
- Delays may occur due to inventory, production, carrier, customs, weather, or other conditions outside our reasonable control.
A fulfillment warehouse, production partner, mailing address, or return address shown on a package is not necessarily a Whereto Design LLC storefront or customer-service location.
Do not send merchandise to a production partner, warehouse, mailing address, or package sender unless we provide prior written return authorization and instructions.
Section 7 — Orders, Billing, and Account Information
We reserve the right to accept, refuse, limit, hold, or cancel an order.
We may limit or cancel quantities purchased per person, household, customer account, payment method, billing address, shipping address, or order. We may also restrict orders that appear to be placed by unauthorized dealers, resellers, distributors, or automated purchasing systems.
If we change or cancel an order, we may attempt to notify you using the email address, telephone number, billing information, or account details provided at checkout.
You agree to provide current, complete, and accurate order, billing, shipping, payment, and account information.
You are responsible for updating your account information when it changes. You are also responsible for ensuring that the shipping address is complete and accurate before submitting an order.
We are not responsible for delays, losses, or additional expenses caused by incorrect or incomplete information supplied by the customer, except where otherwise required by law.
Refunds, replacements, and other order resolutions are subject to our Refund Policy.
Section 8 — Retail, Bulk, and Wholesale Orders
The public Shopify store is primarily a retail storefront. Some products may also be offered in larger quantities or bulk packs.
A bulk-quantity purchase made through the public retail storefront does not automatically establish a wholesale account, resale relationship, territorial exclusivity, authorized-dealer status, or ongoing wholesale pricing.
Direct wholesale transactions may be subject to separate Wholesale Terms, minimum-order requirements, case quantities, payment terms, shipping arrangements, and approval requirements.
Orders placed through third-party marketplaces, including Faire, Etsy, or another platform, are governed by the applicable marketplace’s terms, payment procedures, claims processes, return rules, and policies in addition to any terms that legally apply to the underlying products.
Section 9 — Optional and Third-Party Tools
We may provide access to tools, applications, integrations, payment services, shipping tools, analytics services, social-media features, or other technology provided by third parties.
We do not control all aspects of third-party tools and generally provide access to them on an “as available” basis.
Your use of a third-party tool may be governed by that provider’s own terms and privacy policy. You are responsible for reviewing and accepting the provider’s applicable terms before using the service.
To the extent permitted by law, Whereto Design LLC is not responsible for losses caused solely by a third-party tool or service outside our reasonable control.
New tools, features, products, or Services introduced through the Site will also be subject to these Terms.
Section 10 — Third-Party Links and Services
The Site may contain links to third-party websites, platforms, applications, content, products, or services.
We do not control and are not responsible for the content, accuracy, security, availability, privacy practices, or terms of third-party websites or services.
A link does not necessarily imply endorsement, sponsorship, affiliation, or approval.
Review the third party’s policies and terms before engaging in a transaction or submitting personal information. Questions or complaints about a third party’s independent products or services should be directed to that third party.
Section 11 — Reviews, Comments, and Submissions
You may submit reviews, photographs, comments, feedback, suggestions, or other content through the Site or by communicating with us.
You retain ownership of content that you lawfully own. By submitting content to us, you grant Whereto Design LLC a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to store, reproduce, display, publish, adapt, distribute, and use that content for operating, improving, marketing, and promoting the Services, subject to applicable law and our Privacy Policy.
This license does not give us ownership of your content.
You represent that content you submit:
- Is accurate to the best of your knowledge
- Does not infringe another party’s intellectual-property, privacy, publicity, contractual, or other rights
- Is not unlawful, fraudulent, defamatory, abusive, threatening, obscene, discriminatory, or malicious
- Does not contain viruses, malware, or harmful code
- Does not misrepresent your identity or relationship with another party
We may monitor, remove, decline, or moderate content when reasonably necessary, but we are not obligated to review every submission.
You remain responsible for content you submit.
Section 12 — Personal Information
Our collection, use, disclosure, and retention of personal information are governed by our Privacy Policy, available through the Site footer and checkout.
By submitting personal information through the Site, you acknowledge that it may be processed as described in the Privacy Policy and by the service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide customer support.
Section 13 — Intellectual Property
The Site and its content, including artwork, illustrations, graphics, logos, product designs, photographs, videos, text, layout, branding, and other creative materials, are protected by applicable copyright, trademark, and intellectual-property laws.
Whereto® is a registered trademark owned by Happy Manta, Inc. and is used by Whereto Design LLC with authorization.
Unless otherwise stated, original artwork and creative content displayed through the Whereto® brand are owned by or used with authorization from Happy Manta, Inc.
You may not reproduce, copy, trace, modify, distribute, manufacture from, commercially exploit, create unauthorized derivative works from, or otherwise use protected content without prior written authorization from the applicable rights holder.
Purchasing a product does not transfer ownership of the artwork, trademark, copyright, design rights, digital files, or other intellectual property appearing on or associated with that product.
Section 14 — Errors and Omissions
The Site may occasionally contain errors, inaccuracies, or omissions relating to:
- Product descriptions
- Images or colors
- Prices
- Promotions or discounts
- Shipping charges
- Delivery estimates
- Inventory
- Product specifications
- Availability
- Tax calculations
We reserve the right to correct errors, update information, refuse or cancel orders, and adjust affected transactions when reasonably necessary, including after an order has been submitted.
When an order is canceled because of an error, any amount collected for the canceled portion will be refunded through the applicable payment method.
We are not obligated to update all information except as required by applicable law.
Section 15 — Prohibited Uses
You may not use the Site or Services:
- For an unlawful, fraudulent, deceptive, abusive, or unauthorized purpose
- To violate any applicable law, regulation, ordinance, or legally binding requirement
- To infringe our intellectual property or the rights of another party

- To submit false, misleading, or fraudulent information
- To transmit malware, viruses, or harmful code

- To spam, phish, pharm, pretext, crawl, scrape, or interfere with the normal operation of the Site
- To circumvent security, access controls, purchase limits, or fraud-prevention measures
- To copy, reproduce, trace, manufacture, or commercially exploit protected designs or artwork without authorization
- To use the Site or content for obscene, exploitative, or otherwise unlawful purposes
We may suspend or terminate access for violating these restrictions.
Section 16 — Disclaimer of Warranties
We do not guarantee that access to the Site or Services will always be uninterrupted, timely, secure, or error-free.
We do not guarantee that every result, estimate, delivery date, product description, or other item of information will be completely accurate in every circumstance.
The Site and Services are provided on an “as available” basis to the fullest extent permitted by law.
Except for rights or warranties that cannot legally be excluded, we disclaim implied warranties and conditions, including merchantability, fitness for a particular purpose, title, durability, and non-infringement.
Nothing in these Terms excludes or limits any mandatory consumer right, statutory warranty, or remedy that cannot lawfully be excluded.
Section 17 — Limitation of Liability
To the maximum extent permitted by applicable law, Whereto Design LLC, Happy Manta, Inc., and their respective owners, officers, employees, contractors, service providers, suppliers, agents, licensors, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to the Site, Services, or products.
This may include lost profits, lost revenue, loss of data, loss of opportunity, business interruption, or replacement costs, even if the possibility of such loss was known.
Where liability cannot legally be excluded, liability will be limited to the maximum extent permitted by applicable law.
Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, the exclusions and limitations apply only to the extent legally permitted.
Section 18 — Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Whereto Design LLC, Happy Manta, Inc., and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, suppliers, and service providers from third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from:
- Your material breach of these Terms
- Your unlawful use of the Site or Services
- Content you submit
- Your infringement or violation of another party’s rights
- Your violation of applicable law
This obligation does not apply to the extent a claim results from the negligence, unlawful conduct, or breach of Whereto Design LLC or another protected party.
Section 19 — Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified to the minimum extent necessary to make it enforceable.
The remaining provisions will continue in effect.
Section 20 — Termination
These Terms remain effective until terminated by you or us.
You may stop using the Site or terminate an account at any time, subject to outstanding orders, payments, disputes, or other continuing obligations.
We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms, created a security or fraud risk, used the Services unlawfully, or exposed us or another party to liability.
Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, and dispute resolution.
Section 21 — Entire Agreement
These Terms, together with the policies and notices referenced on the Site, constitute the agreement between you and Whereto Design LLC regarding your use of the Site and Services.
They supersede prior communications or agreements concerning the same subject matter, except for a separate written agreement expressly signed or accepted by Whereto Design LLC.
Our failure to enforce a provision does not waive our right to enforce it later.
Any ambiguity will be interpreted fairly and in accordance with applicable law, rather than automatically against either party.
Section 22 — Governing Law
These Terms and any dispute relating to the Site, Services, or direct purchases from Whereto Design LLC will be governed by the laws applicable to Whereto Design LLC, including the laws of the State of Wyoming, without regard to conflict-of-law principles.
However, nothing in these Terms limits any mandatory consumer-protection right or remedy that applies under the laws of the jurisdiction where you reside.
Orders placed through a third-party marketplace may also be subject to the marketplace’s governing-law and dispute-resolution terms.
Section 23 — Changes to These Terms
We may update these Terms periodically to reflect changes in the Services, our business practices, technology, or legal requirements.
The revised Terms will be posted on this page with an updated “Last updated” date.
Your continued use of the Site after revised Terms are posted constitutes acceptance of the changes, to the extent permitted by applicable law.
